Liability and responsibility
Amis tours accepts no liability whatsoever for any loss, damage, injury, accident, delay or any other irregularity howsoever arising. Amis Tours makes every effort to ensure that all the arrangements and services connected with a client’s itinerary will be carried out as agreed upon in the most efficient and effective way possible. However, we do not have direct control over the provision of services by suppliers and, whilst they are in all cases selected with the utmost care, we do not accept liability for error and omissions of such suppliers. We will not entertain any complaints, or requests for refunds arising from disruption of renovation and any construction activity taking place in any type of accommodation.
Insurance
All clients are advised to take up own and reliable insurance against illness, accident, repatriation, cancellation, theft and for loss of baggage. Clients undertake all activities associated with itinerary at their own risk and are responsible for their own insurance. Amis Tours will not be liable if anyone should fail to take adequate insurance cover.
Original itinerary may change after consultation between Amis Tours and the client. The surplus of the cost will be paid by the client requesting the change. We reserve the right to make changes for our tourists friends. We do not own or control the airlines, hotels and/or other supplier companies who will provide clients holiday components, changes and even cancellations can occasionally become unavoidable. In the event that the hotel accommodation, excursion, service, flight, etc. has been properly confirmed by Amis Tours, and not withstanding this, is unavailable for any reason whatsoever, Amis Tours does not accept any liability.
In case of legal dispute
Amis Tours CC, shall be entitled, at its option to institute any legal proceedings arising out of or in connection with this contract in any Magistrate’s Court having jurisdiction in terms of Section 29 of the Magistrate’s Court Act No 32/1944 as amended, notwithstanding that the amount in issue may exceed the limits of such jurisdiction.
Booking and payment
The tour or any other service to be offered by Amis Tours is confirmed on the condition that a non-refundable deposit of a minimum of 50% of the total package price is paid to Amis Tours. The balance owing must be paid before the commencement of services. Amis Tours reserves the right to cancel any service in respect of payments not received in advance. Special request must be made during consultations. We are very flexible and we will endeavour to comply with the special requests, which will be for the cost of the client, but cannot guarantee that such requests will always be met.
Currency of payment
Amis Tours will accept payment in the following currencies: South African Rand, Euros, American Dollars and British Pounds. We also accept credit cards, bank to bank transfer, money transfer and cash only. All payments to be made into Amis Tours banking account available and supplied to clients during consultation. Any charges made to a client’s credit card (debits) whilst away are the client’s responsibility.
Cancellation and amendments of services
Amis Tours reserves the right to cancel any tour at any time prior to departure, in which event all payments will be refunded as full and final settlement of all further liability of whatsoever nature, howsoever arising, which may arise as a result of such cancellation. In the event of passengers cancelling their reservations such cancellation must be made in writing and notwithstanding anything to the contrary contained in these booking conditions. Amis Tours reserves the right to claim a cancellation fee of up to 100% of the total package price as a pre-estimation of damages. Amis Tours use a large number of suppliers it is not possible to list all their amendment and/or cancellation charges. Accordingly, amendments to confirmed reservations at any time prior to departure will be made subject to the conditions that the customer is liable for all additional costs of whatsoever nature arising there from.
Unplanned extensions
In the unlikely event of there being an unplanned extension to the original program caused by flight delays, bad weather, strikes or any other cause which is beyond the control of Amis Tours, it is understood that the expenses relating to these unplanned extensions, (hotel accommodation etc.), will be for the account of the passenger.
Refunds
No refunds for no-shows, or any unused services.
Breakaways from original program
We will be very flexible to allow clients to breakaway away from itinerary, In this case the extra expenses incurred as a result of such a breakaway will be for the client’s account and any unused service will not be refunded.
General information
This page of terms and condition of our business together with Amis Tours correspondence constitute the sole record of the agreement between us and the clients. No party shall be bound by any representation, warranty, and promise of the like not recorded herein. All costs and disbursements, including legal costs on the attorney and client scale incurred by Amis Tours in recovering any damages and payments payable by the client to Amis Tours shall be for the passengers’ account. This agreement shall in all respects be governed by and construed in accordance with the laws of the Republic of South Africa. The client hereby consents to the jurisdiction of the Magistrates Court having jurisdiction over its person in respect of all proceedings in connection with this agreement. The parties hereby respectively choose domicilium citandi et executandi for all notices and processes to be given and served in pursuance of this agreement at their respective addresses as provided during correspondence.
